Terms of Service

These Terms of Service ("Terms") govern your use of the website at desertsagedrafting.com and all residential design and drafting services provided by Desert Sage Drafting ("Desert Sage," "we," "us," "our"). By using our website, creating a client account, or engaging our services, you agree to these Terms in full. If you do not agree, do not use the site or services.

1. Services

Desert Sage Drafting provides residential design and drafting services including, but not limited to, custom home construction drawings, kitchen and bathroom design, and remodel and addition plans. Services are available to clients nationwide.

Desert Sage Drafting is a drafting and design service, not a licensed engineering or architectural firm. Our drawings are produced to meet permit submittal requirements in most jurisdictions, but we make no guarantee that drawings will be approved by any specific local authority. Certain structural elements may require review and stamp by a licensed engineer, which is the client's responsibility unless separately agreed upon in writing.

2. Payments and Retainers

All fees are outlined during project intake or in a written quote provided to you. A retainer or deposit may be required to begin work on your project. All fees are in U.S. dollars.

Final drawings and deliverables will not be released until payment is received in full. Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend or terminate services on accounts with unpaid balances.

3. Intellectual Property and Drawing Ownership

Desert Sage Drafting retains full copyright ownership of all drawings, plans, designs, and documents we create, regardless of the stage of completion or the amount paid. All drawings are the proprietary intellectual property of Desert Sage Drafting.

Client License: Upon receipt of full payment, Desert Sage Drafting grants the client a limited, non-exclusive, non-transferable license to use the delivered drawings solely for the construction of the one (1) specific project at the specific address for which the drawings were created. This license does not permit:

  • Use of the drawings to construct a second or additional structure at any address without a new written agreement and additional fee
  • Resale, transfer, sublicense, or assignment of the drawings to any third party
  • Modification of the drawings by any party other than Desert Sage Drafting without prior written consent
  • Use of the drawings in any manner inconsistent with the original agreed scope of work

Desert Sage Drafting reserves the right to use any drawings, designs, or project photos for portfolio, marketing, and educational purposes, unless the client requests otherwise in writing prior to project completion.

4. Revisions

Revisions are included as described for each service type on our website. Revisions are intended to refine and improve the design in progress. Requests that constitute a material change to the original project scope — such as a significant change in square footage, floor plan reconfiguration, or addition of new structures — may be treated as a new scope item and subject to additional fees. We will notify you before charging for any scope change.

5. Scope Changes

Any request that expands or materially alters the originally agreed-upon scope of work constitutes a scope change. Scope changes must be agreed upon in writing. We reserve the right to issue a revised quote for any scope change prior to performing the additional work. Proceeding with a scope change constitutes acceptance of any additional fees quoted.

6. Project Abandonment

A project is considered abandoned if the client is unresponsive for sixty (60) or more consecutive days despite reasonable outreach by Desert Sage Drafting. Upon abandonment, we reserve the right to close the project file. Work already performed will be invoiced at $75.00 per hour against any retainer paid. Any remaining retainer balance after invoicing will be refunded per our Refund Policy. To resume an abandoned project, a new intake and retainer may be required.

7. Permitting and Engineering Disclaimer

Our drawings are prepared to meet typical permit submittal requirements. However, building codes, zoning regulations, and permit requirements vary by jurisdiction and are the client's responsibility to verify. Desert Sage Drafting does not guarantee permit approval by any authority. We are not responsible for delays, costs, or modifications required by a building department, homeowner's association, or any other authority having jurisdiction.

Where engineering is required (structural calculations, stamped drawings, geotechnical reports, etc.), the client is responsible for engaging a licensed engineer unless a specific written agreement states otherwise.

8. Client Responsibilities

You agree to provide accurate and complete information regarding your project, site, and requirements. Errors or delays resulting from inaccurate client-provided information — including incorrect square footage, site dimensions, lot information, or existing conditions — are not the responsibility of Desert Sage Drafting. Additional work required to correct drawings due to inaccurate client information may be billed at our applicable hourly rate.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Desert Sage Drafting's total liability to you for any claim arising out of or relating to these Terms or our services — whether in contract, tort, negligence, or otherwise — is limited to the total amount you actually paid to Desert Sage Drafting for the specific project giving rise to the claim.

In no event shall Desert Sage Drafting be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, construction cost overruns, permit denial costs, or loss of use, even if advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Desert Sage Drafting and its owner, employees, and contractors from and against any claims, liabilities, damages, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of our services, (b) your violation of these Terms, (c) inaccurate information you provided, or (d) construction, permits, or regulatory compliance associated with your project.

11. Dispute Resolution

In the event of a dispute arising from or related to these Terms or our services, the parties agree to first attempt resolution through good-faith negotiation. If negotiation fails within 30 days, the parties agree to attempt mediation before initiating any litigation. Mediation shall be conducted in Bernalillo County, New Mexico, or by video conference if mutually agreed.

Nothing in this section prevents either party from seeking emergency injunctive relief to protect intellectual property rights or prevent irreparable harm.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict-of-law principles. Any legal action that proceeds beyond mediation shall be filed in the appropriate state or federal court in Bernalillo County, New Mexico, and you consent to personal jurisdiction in those courts.

13. Termination

Either party may terminate the service relationship at any time with written notice. Upon termination, the client owes payment for all work completed to the date of termination at the applicable rate. Termination does not relieve the client of any outstanding payment obligations. Refunds upon early termination are governed by our Refund Policy.

14. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use of our website or services after any changes constitutes your acceptance of the updated Terms.

15. Entire Agreement

These Terms, together with any written project agreement or quote provided to you, constitute the entire agreement between you and Desert Sage Drafting with respect to the services, and supersede all prior communications and proposals, whether oral or written.
